What is the legal status of CBD in Spain? The keys to not breaking the law with cannabidiol

Is CBD legal in Spain?

This is the question many people are asking themselves lately, both individuals and entrepreneurs considering opening a business based on cannabidiol.

And the answer is very clear. However, because CBD is a substance derived from cannabis (which is illegal), it is often believed that cannabidiol must also be illegal. This creates noise and confusion, and deters many sellers and buyers who do not want to break the law.

But it's time to clear up all doubts. That's why in this article we want to explain:

  • What is the legal status of CBD in Spain.
  • How to sell CBD-derived products without breaking the law.
  • Where to buy CBD products.

Ready to clarify your doubts? Let's go.

✳️ But first, what is the legal status of CBD in Europe?

First of all, it's time to put on your glasses and read a little history (but just a little) to put you in context.

To understand the situation of cannabidiol in our country, we must first look at European legislation, as this currently governs the regulation of CBD consumption and sale in Spain.

In fact, according to the WHO (World Health Organization), cannabis should be removed from the list of prohibited substances that the UN established in 1961 and which is still maintained 60 years later. In other words, this list is already obsolete, which is why the WHO is calling for its update.

This would allow both THC-containing buds (the psychoactive substance in cannabis) and CBD (in this post I explain what it is in depth, and in this one its multiple benefits) to be sold and consumed without problems.

However, after much back and forth (meetings such as the one in Vienna where 53 countries debated the issue), it was concluded that in Europe, THC-containing buds are prohibited (except for very specific medical treatments), but CBD is totally legal, with the exception of its use in food.

And where does that leave us in Spain?

I'll explain it below.

✳️ So, is CBD legal in Spain?

As I mentioned above, in Europe it has been determined that THC-containing buds are harmful to health due to their psychotropic and addictive effects.

However, cannabidiol does not have these psychoactive effects (i.e., it does not "get you high") nor does it cause addiction, which is why its consumption and sale are permitted in most countries on the continent, including Spain.

However, the EFSA (European Food Safety Authority) along with the AEMPS (Spanish Agency of Medicines and Medical Devices) consider that the consumption of food products with a high level of cannabidiol can be harmful, which makes it illegal.

Its sale is not illegal in our country. You can buy them without problems with the peace of mind of not breaking the law, so I recommend you take a look at our catalog and choose the one you like best.

✅ 1. Can CBD be sold in Spain without breaking the law?

The answer is yes, but several things must be taken into account.

Just like its purchase and consumption, the sale of CBD in Spain is legal. Of course, as long as it is not food products.

But this is not a problem, since businesses based on CBD go beyond nutrition. And as an example, here is our online store with CBD buds of all types and the best quality.

In addition, there are many more business options based on CBD in the market, such as:

  • Textile industry: which uses hemp fibers (the plant from which CBD is extracted) to create clothing, ropes and other materials. A clear example is the FashionUnited website, which designs and markets sustainable clothing woven with hemp yarn. You can take a look here: fashionunited.es.
  • Bio-construction: hemp fiber is also used in the construction sector, since when processed it is capable of imitating other materials such as wood, concrete, bricks or plastic. This is why its use in works and constructions is becoming more frequent. A good example of this type of business is Cannabric, a construction company that only uses materials made from hemp: cannabric.com.

In short, as long as they are not foods with a high CBD content, you can sell CBD-derived products in Spain without problems. ;)

✅ 2. How to buy CBD in Spain?

In our country you can find CBD-derived products in exclusive physical stores, as well as in pharmacies or online stores.

But we advise you to opt for online shopping. Why? Because it is the most convenient option (you can browse the catalog from your sofa while comparing different products) and, in addition, it has much more variety than a physical store or pharmacy.

Why don't you check it out for yourself? Take a look at our products:

You're sure to find what you're looking for. ;)

There is still a long way to go with this issue, as some people still confuse CBD with THC, believing it to be harmful to health.

Fortunately, more and more people are learning about and praising cannabidiol, which is why it is more popular than ever. From its therapeutic use, through cosmetic, to recreational use, CBD is here to stay.

I hope this article has helped you to learn more about cannabidiol and its legal characteristics. Remember: its sale and purchase are legal in Spain, except for food products.
